ARTICLE 1 – GENERAL POINTS & SCOPE

 

1.1. The purpose of these general terms and conditions is to govern the contractual relationship between the LP (Limited Partnership) “MARIVAUX SCOMM”, hereinafter referred to as “MARIVAUX HOTEL BRUSSELS”, and any natural or artificial person wishing to use the services of MARIVAUX HOTEL BRUSSELS within the framework of a booking, hereinafter referred to as the “Client”. The term “Parties” refers to both MARIVAUX HOTEL BRUSSELS and the Client.

1.2. These general terms and conditions apply to individual bookings. Separate rules and conditions apply to group and conference bookings. Any reservation of 10 or more bedrooms is referred to as “group reservation”

1.3. These general terms and conditions apply in full to any contract concluded by the Client with MARIVAUX HOTEL BRUSSELS and, by exclusion, take precedence over any divergent terms and conditions, provisions or terms stated in brochures, leaflets, on Websites or in sales and marketing material, irrespective of their nature.

1.4. Every booking made by the Client with MARIVAUX HOTEL BRUSSELS implies full and complete acceptance of these general terms and conditions, notwithstanding any inconsistencies with any of the Client’s general terms and conditions, even if the latter are dated later than and/or contain a clause equivalent to these general terms and conditions.

1.5. These general terms and conditions are brought to the attention of the Client, on the one hand, by their addition to the service-level offer (booking, etc.) and, on the other hand, by their attachment to the invoices or by reference to the back of the invoices. Therefore, whenever a Client uses the services of MARIVAUX HOTEL BRUSSELS, he is deemed to have read these general terms and conditions carefully and agreed to them unreservedly for any subsequent booking.

1.6. Should MARIVAUX HOTEL BRUSSELS decide, at any given time, not to seek application of any provision whatsoever of these general terms and conditions, that fact shall not, under any circumstances, be interpreted as amounting to the waiving, on its part, of the right to seek application of that provision subsequently.

 

 

ARTICLE 2 – DEFINITIONS

 

It is agreed that the terms (words) included in these general terms and conditions will have the following meanings:

  • Room: All the rooms offered by MARIVAUX HOTEL BRUSSELS (standard, Club, superior Harmony or Deluxe, Junior Suite room, etc.).
  • Data: Personal data within the meaning of the General Data Protection Regulation (GDPR).
  • Technical Equipment: Audiovisual and technical equipment ordered through the hotel’s designated partners.
  • Pro Forma Invoice: Estimation by the hotel of the total price of services, used for advance payment calculations.
  • Final Invoice: The final calculated price of all services provided to the Client.
  • No-Show: A booking which has not been cancelled by the Client even though the participants have failed to check in at the hotel.
  • Group Booking: A room and/or event booking made by the Client for a group of at least ten (10) rooms.
  • Catering: Supply of food, meals, and drinks by MARIVAUX HOTEL BRUSSELS.
  • Services: All services offered to the Client within the framework of the contract. The basic price does not cover external event costs (such as SABAM fees or municipal entertainment taxes), which remain the sole liability of the Client.
  • Extra Services: Any additional services requested during the stay by the Client or their representatives, which will be invoiced on top of the contract.

 

 

ARTICLE 3 – RATES, TAXES & BELGIAN VAT COMPLIANCE

 

3.1. The room and catering rates indicated and presented by MARIVAUX HOTEL BRUSSELS include Belgian VAT at the legal rates of 12% for overnight stays and 12% for food/catering services, and 21% for alcoholic and non-alcoholic beverages, room hire, and technical/audiovisual equipment.

3.2. Rates include service charges but exclude the regional Brussels tourist accommodation tax (city tax), which must be paid by the Client to the authorities.

3.3. Rates are valid only for the dates, models, and volumes stated. Any amendment to the program may entail a price review. The hotel reserves the right to adjust rates in the event of official changes to taxation, VAT, or economic indicators.

 

 

ARTICLE 4 – BOOKING AND CANCELLATION POLICY

 

4.1. Non-refundable rate: No free cancellation – 100% prepayment at booking.
The credit card provided for the guarantee will be charged on the day of the reservation.

4.2. Flexible rate: Free cancellation until 24 hours prior arrival date.
The credit card provided for the guarantee will not be charged.
Cancellation fee (less than 24 hours before date of arrival): 100% (entire stay).
The credit card provided for the guarantee will be charged.

 

 

ARTICLE 5 – INSUFFICIENT NUMBER OF ROOMS – SEND-OUT POLICY

 

5.1. If, not enough rooms are available for the Client’s confirmed booking, MARIVAUX HOTEL BRUSSELS will accommodate the Client in another hotel of the same grade.

5.2. MARIVAUX HOTEL BRUSSELS will assume the costs of transportation as well as the costs of accommodation at the alternative hotel. Under no circumstances will MARIVAUX HOTEL BRUSSELS be obliged to pay damages of any kind whatsoever to the Client.

 

 

ARTICLE 6 – ARRIVAL/DEPARTURE TIMES AND CONDITIONS OF ACCESS TO THE HOTEL

 

6.1. The earliest time of arrival (check-in time) at MARIVAUX HOTEL BRUSSELS is scheduled for 15:00. On the day of departure, the Client should leave (check-out) by 11:00 at the latest.

6.2. Access to MARIVAUX HOTEL BRUSSELS is arranged prior to the arrival of the Client and of his participants. Any applicable codes are sent to the Client when the booking has been confirmed and guaranteed by the payment from the Client in accordance with these general terms and conditions. They are provided, at the latest, on the actual day of the arrival of the Client and of his participants.

6.3. In the event of occupancy requested between 06:00 and 11:00 in the morning, a whole night charge will be invoiced. In the event of occupancy requested between 11:00 and 15:59, hourly charges apply. In the event of late departure or occupancy: after 16:00, an additional night will be invoiced.

 

 

ARTICLE 7 – OBSERVANCE OF THE HOTEL RULES AND REGULATIONS

 

7.1. The Client undertakes to conduct himself in a sensible and responsible manner in MARIVAUX HOTEL BRUSSELS and to follow the rules and regulations of the Hotel.

7.2. Any serious or repeated breach of this provision will be regarded as gross misconduct on the part of the Client, giving MARIVAUX HOTEL BRUSSELS the right to terminate the Client’s stay and/or that of the people under his responsibility, without notice and without prejudice to the amounts payable.

 

 

ARTICLE 8 – RESPONSIBILITY/LIABILITY OF THE CLIENT

 

The Client is liable to MARIVAUX HOTEL BRUSSELS both as far as the people under his responsibility are concerned and for any damage, loss or injury that he or they may cause to people, the property, equipment or facilities and other fixtures, fittings and installations of MARIVAUX SCOMM; and, in general, to the areas to which the public have access.

 

 

ARTICLE 9 – FORCE MAJEURE

 

MARIVAUX HOTEL BRUSSELS shall not be held liable for the full or partial non-fulfilment of its obligations, if that non-fulfilment is due to the occurrence of a factor constituting an act of God or the occurrence of a factor constituting force majeure, such as, among other things and without this list being exhaustive: flooding, fire, storms, terrorism, strikes or an act of the public authority.

 

 

ARTICLE 10 – LIABILITY, INSURANCES & THEFT


10.1
. The Client is fully liable to MARIVAUX HOTEL BRUSSELS for any damage, loss, or injury caused to individuals, building structures, or equipment by the participants or external vendors hired by the Client. The Client must maintain adequate third-party liability insurance and produce a certificate upon request.

10.2. MARIVAUX HOTEL BRUSSELS is not liable for the theft, loss, or deterioration of equipment, materials, or documents brought into the hotel or left unsupervised in meeting rooms by the Client or participants.

 

 

ARTICLE 11 – ANIMALS AND SMOKERS

 

11.1. Pets are not permitted within the MARIVAUX HOTEL premises. Guests are not allowed to bring pets into guest rooms or public areas of the hotel. The hotel reserves the right to refuse accommodation or terminate a stay without refund if this policy is violated. Assistance dogs required by law are exempt from this restriction.

11.2. Smoking is banned in MARIVAUX HOTEL BRUSSELS (including but not limited to: rooms, stairwells, lifts and corridors and any area accessible to the public, in accordance with the law of 22nd December 2009). In the event of infringement of this ban, a cleaning forfeit of 250 EUR (net of VAT) will be invoiced to the Client, on the understanding that a higher amount could be invoiced to the Client if MARIVAUX HOTEL BRUSSELS were to observe more significant damage (including but not limited to being prevented from taking another reservation for the room).

 

 

ARTICLE 12 – MINORS

 

12.1. No bookings for minors (persons under 18) will be accepted.

12.2. MARIVAUX HOTEL BRUSSELS reserves the right to refuse access to its premises and to cancel any booking for any minor unaccompanied by his/her legal representative

12.3. MARIVAUX HOTEL BRUSSELS may also cancel any stay if it becomes apparent that the booking will be used to accommodate minors unaccompanied by their legal representatives.

 

 

ARTICLE 13 – PROTECTION OF PERSONAL DATA (GDPR)

 

13.1. Client data is processed by the hotel for commercial booking management, invoicing, statistics, and promotional interactions in accordance with GDPR requirements.

13.2. Data may be shared with standard external service providers necessary to execute the contract. Any data transfers outside the European Economic Area (EEA) will strictly utilize standard contractual clauses (SCCs) or other legally approved transfer frameworks under Chapter V of the GDPR.

13.3. Individuals retain the right to access, correct, object to, or delete their personal data by contacting privacy@hotelmarivaux.be.

 

 

ARTICLE 14 – NULLITY

 

14.1. If any provision whatsoever of these terms and conditions or of the service-level agreement is declared unworkable or invalid, whether wholly or partially, the relevant provision (or, if applicable, the relevant part of that provision) will be deemed not to form an integral part of the agreement. The validity and fulfilment of the other parts of the agreement will not be affected under any circumstances.

14.2. In addition, the parties will, immediately and in good faith, enter into negotiations with the aim of replacing the provision declared null or unworkable, if applicable with retroactive effect to the date on which the agreement came into effect, with another provision, which is valid and workable and the legal effects of which are as close as possible to the invalid or unworkable provision.

 

 

ARTICLE 15 – APPLICABLE LAWS AND COMPETENT COURTS

 

15.1. If any provision of these terms is declared invalid or unworkable by a court, the validity of the remaining provisions shall not be affected. The parties agree to replace the invalid clause with a valid one that closest matches the original commercial intent.

15.2. These general terms and conditions and all contractual relations arising from them are governed exclusively by Belgian law.

15.3. In the event of a dispute, the courts and tribunals of Brussels have sole exclusive jurisdiction.
